Warning to retailers after stores alcohol licence is revoked

Traders are being warned not to sell alcohol to underage buyers after a Derbyshire shop had its licence revoked.

Sanjay Selvam (23) of Roses Main Stop, in Main Road, Shirebrook, had his premises licence removed after two sales of alcohol were made to underage volunteers during an investigation we carried out with police on 30 November 2013.

The decision was made at a hearing held by Bolsover District Council yesterday (Wednesday 16 April) following a recommendation by our trading standards team and means Selvam will no longer be legally allowed to sell any alcohol products in his store.

Our Cabinet Member for Health and Communities Councillor Dave Allen said:

"The outcome of this review sends out a clear message to retailers that they must trade within the law or face the consequences. We work very hard to support law-abiding traders and to keep members of the public safe and this kind of sales activity will not be tolerated. It’s not worth retailers risking an underage sale because it could lead to the loss of their licence - either temporarily or permanently as in this case. This trader will no longer legally be allowed to sell alcohol, which I imagine will have a significant impact on his business. The risks are just not worth it."

We are responsible for enforcing sections of the Licensing Act 2003 which make it an offence to sell alcohol to anyone aged under 18.

Trading standards officers and partner agencies have been monitoring Roses Main Stop since police raised underage sales concerns in November 2011. Since then, three members of Selvam’s family have each received fixed penalty notices for selling alcohol to children during underage checks.

Following an underage sale from the shop in April 2012 Selvam was offered an action plan to improve checks on young customers and apply a ’Challenge 25’ policy, but when trading standards officers tested this in August 2013, alcohol was sold to an 18-year-old volunteer without being asked for ID. During a routine visit a month later, bottles of non-duty paid vodka were also found on sale at the premises.

The failings were highlighted to Bolsover District Council’s Licensing Sub-Committee by trading standards officers in their presentation.

Alcohol sale bans come into effect 21 days after shop owners receive a letter informing them of a revocation order. They have the right to appeal.
